1. Overview and Scope

This Refund and Return Policy ("Policy") is published by Lively Graphics, LLC ("Company," "we," "us," or "our") and governs all subscriptions and account arrangements made in connection with the Calimento iOS mobile application. Our marketing website and these policy pages are available at calimento.io.

Calimento is a digital-only service. We do not sell or ship physical products, and we operate no e-commerce store. Accordingly, this Policy does not address product returns, physical exchanges, or shipping-related refunds. The only paid offering is the Calimento Pro subscription, billed exclusively through Apple In-App Purchase.

This Policy is incorporated into, and should be read together with, the Calimento Terms of Use and Privacy Policy, both available at calimento.io.

2. Digital Services — No Physical Returns

All products and services offered by Calimento are digital in nature. A Calimento Pro subscription provides access to a software application and its cloud-hosted features, including recipe management, meal planning, AI Vision scanning, and related tools. No tangible goods are manufactured, sold, or shipped in connection with any Calimento subscription.

Because no physical product is transferred to you in connection with a Calimento subscription purchase, conventional "return" rights — such as those applicable to retail goods under the Washington Consumer Protection Act or federal consumer protection regulations — do not apply. Your rights with respect to subscription purchases are governed by this Policy and Apple's Media Services Terms and Conditions.

3. Nature of Subscription Access

A Calimento Pro subscription grants you a limited, non-exclusive, non-transferable license to access and use the features of the Calimento application for the duration of your active subscription period, as further described in the Calimento Terms of Use, Section 4.

When you initiate a subscription, you receive immediate access to all features included in Calimento Pro. Because the digital service is delivered and consumed immediately upon purchase, and because we incur infrastructure and licensing costs from the moment access is granted, subscription fees are generally non-refundable once the subscription period has commenced. All refund decisions for subscription charges rest with Apple, as described in Section 4.

This general no-refund position does not limit or waive any rights you may have under applicable law, including the Washington Consumer Protection Act (RCW 19.86) or any other statute that independently confers refund or cancellation rights upon consumers.

4. Apple App Store Subscriptions

4.1 Apple as Merchant of Record

All Calimento Pro subscriptions are processed exclusively by Apple, Inc. through Apple In-App Purchase. Apple acts as the merchant of record for all subscription transactions. Your payment relationship is directly with Apple — not with Lively Graphics, LLC. We never receive or store your payment card information.

⚠ Important — Refund Authority Lively Graphics, LLC does not have access to your Apple payment information and cannot process, approve, or deny refunds for any subscription purchased through Apple In-App Purchase. All refund requests must be submitted directly to Apple. Contacting Lively Graphics, LLC about a subscription refund will not result in a refund being issued.

4.2 How to Request an Apple Refund

To request a refund for a subscription charge, follow Apple's official refund process:

  1. Visit reportaproblem.apple.com and sign in with your Apple ID.
  2. Locate the Calimento charge you wish to dispute.
  3. Select "I'd like to request a refund" and choose the applicable reason.
  4. Submit your request. Apple will review it and communicate its decision to you directly, typically within a few days.

Alternatively, you may contact Apple Support at support.apple.com. Apple's refund decisions are made at Apple's sole discretion pursuant to Apple's own Media Services Terms and Conditions. Lively Graphics, LLC has no ability to influence Apple's refund decisions.

4.3 Auto-Renewal and Cancellation

Calimento Pro automatically renews monthly at $3.99/month unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Renewal charges are applied to your Apple ID account within 24 hours prior to the end of the current period. To cancel and prevent future renewal charges:

  1. Open Settings on your iPhone or iPad.
  2. Tap your name at the top, then tap Subscriptions.
  3. Select Calimento and tap Cancel Subscription.

Cancellation stops future renewal charges but does not trigger a refund for the current or any prior subscription period. You will retain access to Calimento Pro through the end of the period you have already paid for.

4.4 30-Day No-Cost Access Period

Every new Calimento user receives 30 days of full App access at no charge (the "No-Cost Period"). No payment method is required to create an account or during the No-Cost Period. This is a developer-managed access period tracked in Calimento's backend — it is not an Apple In-App Purchase Introductory Offer, and no charge is applied during this period.

There is no free tier beyond the No-Cost Period. At the end of the No-Cost Period, continued access requires an active Calimento Pro subscription. If you choose to subscribe at $3.99/month through Apple In-App Purchase, the first month's charge is applied immediately at the moment of purchase confirmation — there is no additional free period at checkout. Subsequent charges and any refund requests are subject to Apple's refund policy and must be directed to Apple as described in Section 4.2.

5. Billing Errors and Disputed Charges

Because all Calimento subscription payments are processed by Apple, billing errors — such as a charge after cancellation, an incorrect amount, or a duplicate charge — appear on your Apple ID account and must be disputed directly with Apple through reportaproblem.apple.com or Apple Support, as described in Section 4.2. We do not have visibility into your Apple billing records and cannot resolve Apple billing disputes.

If you believe a billing error has resulted in incorrect subscription status within the App — for example, you were charged by Apple but the App does not reflect your active subscription — please contact us at admin@livelygraphics.com with the subject line "Subscription Access Issue" and include your account email and the date of the Apple charge. We will investigate the App-side entitlement and respond within three (3) business days. Resolving the App access issue does not constitute, and is separate from, any refund determination by Apple.

6. Washington State Consumer Rights

Lively Graphics, LLC is a Washington State limited liability company, and this Policy is governed by the laws of the State of Washington. Nothing in this Policy is intended to limit or waive any rights you may have under the Washington Consumer Protection Act (RCW 19.86) or any other applicable consumer protection statute.

Under Washington law, unfair or deceptive acts or practices in trade or commerce are unlawful. If you believe that a billing or refund practice of Lively Graphics, LLC constitutes an unfair or deceptive practice, you may file a complaint with the Washington State Attorney General's Consumer Protection Division at atg.wa.gov/consumer-protection or by calling 1-800-551-4636. Filing a complaint with the Attorney General does not affect your right to pursue individual legal remedies.

Washington's automatic renewal law (RCW 19.350) requires clear and conspicuous disclosure of auto-renewal terms before a subscription is charged. Those disclosures are contained in the Calimento Terms of Use, Section 4, and are displayed at the point of purchase within the App. If you believe you were enrolled in an auto-renewing subscription without adequate disclosure, please contact us immediately at admin@livelygraphics.com.

7. Modifications to This Policy

We reserve the right to modify this Policy at any time. Material changes — particularly those that affect the refund rights of active subscribers — will be communicated by in-App notice or email at least 30 days before taking effect. Non-material clarifications may be updated with shorter or no advance notice.

Changes to this Policy do not apply retroactively to subscription periods already paid for at the time the change takes effect. If we make a change that materially reduces your refund rights for future subscription periods, you will have the right to cancel your subscription before the change takes effect without penalty.

Your continued use of Calimento after a policy change takes effect constitutes your acceptance of the revised Policy.
